Terms and Conditions

TERMS AND CONDITIONS

These booking conditions apply to any of our Tours. On payment of your deposit you are accepting our terms and conditions. Freedom Motorcycle Tours reserves the right to update or amend these terms and conditions at any time. It is your responsibly to check these terms and conditions regularly for any changes.

1.Terms

The following ‘terms’ shall apply. ‘Freedom Motorcycle Tours Ltd’ or ‘us’ or ‘we’ refers to the owner of the website. The terms ‘you’ or ‘Participant’ refers to the user or viewer of our website. The term ‘tour’ is the tour you have chosen from the brochure.

2.Bookings

When you make a booking you guarantee that you have the authority to accept and do accept on behalf of all members of your party, the terms of these booking conditions. The first named person on the booking will be the party leader and will be responsible for making all payments due to us. All bookings are made on a first-come first-served basis. Freedom Motorcycle Tours Ltd reserves the right to decline any booking at their discretion.

If you are booking as a solo rider in a shared room you are accepting that you are willing to share with another person of our choosing booking under the same conditions. Solo rider, shared room bookings are taken on a first come first served basis. In the event that another solo rider, shared room booking is not made on your chosen tour then you are accepting that you will be changed to a solo rider, single room status and the supplement will need to be paid. In accepting these terms and conditions for shared room bookings you are accepting that Freedom Motorcycle Tours Ltd cannot be held accountable if for any reason either party in the room are not compatible.

3.Deposit

A deposit per person is required to book a place on any of our Tours. All deposit payments can be paid by either STRIPE, direct bank transfer (contact 0780 9879873 for details) or cheque made payable to: Freedom Motorcycle Tours Ltd. Upon receipt of the deposit and completed booking form it is agreed that you are accepting Freedom Motorcycle Tours Ltd terms and conditions and we will reserve a place on your chosen tour. All deposits are non-refundable and non-transferable, irrespective of circumstances.

4.Payment of balance

Upon receipt of a completed booking form and deposit you will be issued with a confirmation notice and invoice via email which contains details of your tour reservation, terms and conditions and the tour ‘balance payment’ date. On our Tours the full balance payment is due no later than 60 days before date of travel or your reservation will be cancelled. Balance payment can be made by direct bank transfer (contact 0780 9879873 for details), card payment over the phone, or cheque. Bookings made 60 days or less before the departure date will be accepted only with full payment or by prior agreement. Only those who have paid in full will be allowed to participate in the tour.

5.Protection of your money

Freedom Motorcycle Tours Ltd is a company committed to customer satisfaction and consumer financial protection. We comply with Package Travel, Package Holiday and Package Tour Regulations 1992. The policy will also include repatriation if required, arising from the cancellation or curtailment of your travel arrangements due to the insolvency of Freedom Motorcycle Tours Ltd. This insurance has been arranged by IPP (International Passenger Protection Limited). Policy exclusions: this policy will not cover monies paid for Travel Insurance or any claim relating to Air Flights. Please ensure the Company you have booked with has appropriate CAA/ATOL Bonds in place.

6.Security Repatriation

In the case of insolvency during any stage of a Tour Freedom Motorcycle Tours Ltd will provide you with a valid return Eurotunnel/ferry ticket as appropriate.

7.Insurance

On all our European Tours it is a condition of booking that you hold valid and adequate breakdown/ recovery insurance which will include repatriation of you, your pillion (if applicable) and your motorcycle in the event of accident/breakdowns. Participants must also arrange adequate personal and medical insurance to cover treatment and repatriation in the event of accident/illness. Each eligible Participant should also carry a ‘European Health Insurance Card’ (EHIC).

8.Transfer or changes to your booking

In the event of you having to cancel the Tour for any reason you may transfer the booking to another person providing a minimum of two week notice is given, this will incur a £50.00 administration charge plus any additional direct costs we may incur.

Any changes to your personal details including email address, motorcycle details or any other personal information is subject to a £50.00 Freedom administration charge per amendment which we may apply at our discretion

9.Our Responsibilities

Freedom Motorcycle Tours Ltd is responsible for ensuring that any part of the tour programme booked, where it is within their control, is supplied as described in the tour brochure. However, please be aware that during the tour some amenities (ie hotel lifts, swimming pools etc) require regular servicing and cleaning and therefore may be inaccessible at times. We cannot be held responsible for some amenities being affected by local conditions, maintenance, weather conditions or mechanical breakdowns. Freedom Motorcycle Tours Ltd makes reasonable efforts to ensure that the correct arrangements have been made for all the tours in the brochure and that the suppliers of services are efficient and reputable. You will be provided with comprehensive GPS data, detailed maps and full hotel addresses. The guiding of the Tour is done purely at our discretion. We reserve the right at our absolute discretion to ask you to ride alone if you are not keeping pace with the group, although this would only happen in exceptional circumstances

Freedom Motorcycle Tours Ltd cannot be held responsible for death, personal injury or illness caused by activities engaged in which are outside the tour itinerary. We also cannot be held responsible for death, personal injury or illness howsoever caused unless we are shown to be negligent. We have no influence or control over your riding ability or skills, it is entirely your responsibility to ensure you are safe and riding within your own ability and abiding by local laws for each country. Also, we are not responsible for any loss or damage to your property including your motorcycle irrespective of how any damage may have been caused.

10.Your responsibilities

Participation in any tour is entirely at your own risk. On our European tours you are responsible for your motorcycle including mechanical or accident repairs. You are always responsible for yourself, or any pillion travelling with you. Any accident, bodily injury, illness or death to rider or pillion during your tour is not the responsibility of Freedom Motorcycle Tours Ltd, it is your responsibility to hold personal travel insurance for both yourself and your pillion should you have one.

It is the Participants responsible to ride their motorcycle in accordance with local laws, rules and regulations. Any motorcycle accident involving a Participant with an unrelated third party or another Participant, will never be Freedom Motorcycle Tours Ltd responsibility.

When booking a tour we assume that the participant (and pillion if applicable) will have read the Tour Itinerary and will be fully aware of the route, destinations and the approximate mileages for each day and will have made the judgement that it is an appropriate tour for them to undertake.

Our tour gradings have been given in good faith but without any responsibility to Freedom Motorcycle Tours Ltd whatsoever. It is the Participants responsibility to choose the appropriate Tour to their skill level and ability. We cannot be held responsible if the Participant is out of their comfort zone in regards to the grading and difficulty of the Tour.

10a) You must be a competent rider with a machine that is road legal and of a type suitable for touring. It is your responsibility to ensure that your motorcycle is in a road worthy condition for the tour you are going to undertake.

10b) You must hold a valid driving license

10c) You must hold a valid UK passport and visa if required

10d) You must hold a valid Certificate of Insurance covering your Motorcycle, rider and pillion.

10e) You must have the ability to get you, your pillion and/or bike home in the event of a breakdown, accident or emergency.

10f) You must advise Freedom Motorcycle Tours Ltd of any illness, medical conditions, allergies or dietary needs that may affect your tour.

10g) You must hold a European Health Insurance Card (EHIC) (can be obtained online at www.dh.gov.uk/travellers or by post from any main Post Office)

10h) You must hold the appropriate level of valid breakdown cover for your Motorcycle. This should include repatriation cover in the event of an accident or breakdown.

10i) You must hold valid personal travel Insurance for you and your pillion (if appropriate). This must include medical cover including any possible repatriation in the event of serious illness or accident. Freedom Motorcycle Tours Ltd is not responsible for any disruption to your tour due to you failing to carry these documents or your loss of these documents. All additional direct and indirect costs incurred by the Participant to replace documents or because they cannot continue with the Tour are borne by the Participant and refunds will not be made for any part of the Tour missed.

11.Your Conduct

We expect a level of competency and an ability to fully control your motorcycle at all times. You are expected to ride in a courteous and safe manner in respect to your fellow riders and other road users. If we feel you are not riding in a safe and courteous manner and putting other members of the group or other road users at risk we reserve the right at our absolute discretion to ask you to leave the tour group and ride alone.

We reserve the right at our absolute discretion to terminate your Tour without prior notice should your behaviour be such that it is likely in our opinion to cause danger, annoyance or damage to any other person or property.

We have a zero tolerance policy regarding any type of abuse. Any form of threatening behaviour, verbal, racial or physical abuse to another member of the group or towards any of our staff, contractors or tour leaders will result in you being expelled from the tour and your tour terminated.

In any of these circumstances the Participant(s) concerned will be required to leave the Tour and we will have no further responsibility to them including any return travel arrangements. No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination.

12.Changes out of our control

At all times we endeavour to provide the best service and services described in our tours. However, we reserve the right to make changes to our advertised tours, pricing and itineraries when considered appropriate. Such changes can include, but are not limited to accommodation problems, industrial action, acts of God, changes to travel resulting from UK redrawing from the European Union. You will be notified in writing where possible should any of these changes arise.

13.If Freedom Motorcycle Tours Ltd changes your booking

Arrangements for your tour are made some months in advance it is therefore possible that minor changes to an itinerary might be necessary. In most cases, these changes will be minor and will not affect your holiday. However, if significant changes are made after you have booked, (i.e. point of departure, date of departure, final destination or any event which may reduce the quality of the tour) you are free to continue with the tour with the revised itinerary or accept the offer of an alternative tour of the same value. Alternatively, the booking may be cancelled in return for a voucher to the value of the deposit valid for 12 months from the date of original booking.

Once the tour has commenced Freedom Motorcycle Tours Ltd reserves the right to alter routes and accommodation at short notice due to circumstances beyond our control. In this situation Freedom Motorcycle Tours Ltd will notify you as soon as reasonably possible.

14.If Freedom Motorcycle Tours Ltd cancels you’re booking

Freedom Motorcycle Tours Ltd reserves the right, in any circumstances, to cancel your booking and will notify you as soon as reasonably possible. However, this would only become necessary in exceptional circumstances. In such an event we would:

a) offer you an alternative tour of equal or greater value or: b) offer you a voucher, valid for 24 months from date of booking, to the value of your deposit. Freedom Motorcycle Tours Ltd will not be held responsible or offer a refund or compensation in any of the following situations: terrorist activity, pandemic, biological outbreaks, war, threat of war, civil strife, riots, natural or nuclear disasters, industrial disputes, unavoidable technical problems with transport or acts of god.

13a) In the extraordinary event that the UK Foreign Commonwealth Office (UKFCO) advise against travelling to a country that you are booked to tour to, or through, Freedom Motorcycle Tours Ltd will absolutely follow the advice and the tour will not go ahead as planned. In such an extraordinary event, Freedom Motorcycle Tours Ltd will not be held responsible for reimbursing payments or deposits due to hotels and transport already paid for. Extraordinary events are such like (but not exclusive to) terrorist activity, pandemic, biological outbreaks, war, threat of war, civil strife, riots, natural or nuclear disasters, industrial disputes, unavoidable technical problems with transport or acts of god. In this instance you will need to contact your personal travel insurance company to make a claim in respect to the advice of the UKFCO.

13b) Freedom Motorcycle Tours Ltd will not be held responsible for the reimbursement, in part or in whole, of any pre-booked hotels or transport arrangements relating to your tour should we cancel. This includes but is not limited to - hotel bookings (commonly on the eve of departure or the last day of travel), any flights, ferries or train travel costs, taxis, buses, or rental costs or any other out of pocket costs or expenses incurred as a result of the tour being cancelled. Personal travel insurance is advised.

15.If you cancel your European booking

If you cancel your booking following confirmation Freedom Motorcycle Tours Ltd reserves the right to withhold the deposit/tour payment in part or full for costs incurred on the following scale:

More than 60 days: Loss of deposit

59 to 46 days: 25% of tour minus a £50 admin fee

45 to 30 days: 50% of tour minus a £50 admin fee

29 days or less: No refund

All Cancellations must be received in writing and sent to: Freedom Motorcycle Tours Ltd, The Queens Head, Station Road West, Stowmarket, IP14 1EF Once the tour has commenced if for any reason a participant decides to leave the tour before the end he/she will not be refunded. Freedom Motorcycle Tours Ltd will not be responsible for any associated cost incurred.

16.Delays in your journey (Force Majeure)

Freedom Motorcycle Tours Ltd cannot be held responsible for unforeseen delays caused by: terrorist activity, pandemics, biological warfare, war, threat of war, civil strife, riots, natural or nuclear disasters, industrial disputes, unavoidable technical problems with transport, failure of hoteliers, blockades, acts of god, ferry operators or other suppliers. Freedom Motorcycle Tours Ltd cannot be held responsible for any compensation or delays to a journey including International or internal flights, Eurotunnel crossings and ferry crossings (to or from the UK or other ports). In the event of any of the above, refunds or compensation cannot be made and participants will be responsible for providing all their own additional meals, travel and accommodation.

17.Surcharges

The tour price will not be subject to a surcharge save that in exceptional circumstances resulting from Government action affecting transportation cost and/or currency fluctuations. There may be instances where circumstances beyond our control dictate an increase in the cost. We will not pass on any increase less than 2%. Freedom Motorcycle Tours Ltd reserves the right to introduce a proportionate surcharge for increases larger than this if they occur more than 60 days before travel. If as a result of the surcharge the increase is more than 10% of the stated tour price you will be given the option to cancel your booking and receive a full refund.

18.Photography

We may take photographs, video and film footage of any participant (and/or pillion) and your motorcycle whilst on tour. We reserve the right to use such material for any advertising, brochure, video production, social media or for any other marketing uses without obtaining further consent.

19.Release of Liability and Assumption of all Risks

By paying the deposit for any tour with Freedom Motorcycle Tours Ltd, you are accepting our terms and conditions you acknowledge that motorcycling and travelling entails known and unanticipated risks. You also accept that such risks simply cannot be eliminated without jeopardising the essential qualities of the activity. The risks include, but are not limited to travelling in mountainous terrain, altitude, civil unrest, forces of nature, all forms of transportation, accident or illness in remote areas without proper medical facilities or means of rapid evacuation.

By accepting our terms and conditions you acknowledge and hereby release Freedom Motorcycle Tours Ltd, their guides, any members of staff or contractors from any and all liability arising from physical or emotional injury, paralysis, illness, death, delays, damage to property, or to third parties, recklessness of any kind, and from any and all claims, demands or expenses resulting from the tour.

You expressly agree and promise to accept and assume all of the risks existing in this activity. You accept that participation in this activity is purely voluntary, and you elect to participate in spite of the risks.

This release of liability and assumption of all risks statement applies to all members of my family and are binding upon my heirs, legal representatives and assigns.

20.Complaints procedure

In the event of you wishing to make a complaint, you should in the first instance approach your tour representative. If you still consider that your complaint has not been properly addressed, you should put your comments in writing and send to: Freedom Motorcycle Tours Ltd, The Queens Head, Station Road West, Stowmarket, IP14 1EF.

You should note that it is unreasonable to take no action whilst on Tour, but to then write a letter of complaint upon return. If you remain dissatisfied, you must write to us formally by post, not email, within 28 days of your return from holiday giving full details of your complaint. If you fail to follow this simple complaints procedure (on tour and on your return home), we cannot accept responsibility as we would have been deprived of the opportunity to investigate the matter and hopefully rectify any problem.

21.Applicable Law

The contract between and these booking conditions are governed by and construed in accordance with the laws of England and Wales. In the case of any dispute that cannot be settled amicably, both you and Freedom Motorcycle Tours Ltd agree to submit to the exclusive jurisdiction of the courts of England and Wales.

22. Local laws & customs

Each Participant must abide by all local laws and customs of the countries visited, including but not limited to motorcycle clothing and equipment, traffic regulations, the Participants ability to ride the motorcycle and all other laws. In the event that any participants are stopped or detained by local authorities the consequence of this remains the Participants responsibility. Freedom Motorcycle Tours Ltd are not obliged to unduly delay any part of the Tour. Freedom Motorcycle Tours Ltd reserves the right at our absolute discretion to order a Participant to leave the Tour if they are found contravening such laws and customs, or interfering (or is judged to have the potential to interfere) with the well-being of the group, other Participants, or if they are putting the progress of the Tour in jeopardy. If you commit an illegal act Freedom Motorcycle Tours Ltd will cease to have any responsibility to or for you. In accordance with data protection we hereby declare that we only store your name, address and bike registration for the purposes of booking the tours. If you wish for all information to be deleted or destroyed please let us know.

23.Disclaimer

Payment of deposit or transference of any monies to Freedom Motorcycle Tours is considered acceptance of these terms and conditions. It is each person’s responsibility to read and understand the terms and conditions.

EUROPEAN TOURS DISCLAIMER

I have read and understood Freedom Motorcycle Tours Ltd terms and conditions and I expressly agree to abide by their terms of business. I certify that my motorcycle is road legal and that I hold a valid certificate of insurance covering my motorcycle, rider and pillion (if applicable). I also certify I hold valid personal travel insurance and breakdown cover that includes the ability to get myself, my pillion (if applicable) and my motorcycle home in the event of illness, accident, breakdown or emergency and will cover any medical treatment that I (or my pillion) may need. I have read the tour itinerary and I have made the judgement that the tour is suitable for both me and my pillion (if applicable). I am fully aware of the route, destinations, approximate mileages, types of roads and I have made the judgement that the tour is appropriate to my experience level and ability. I understand that Freedom Motorcycle Tours reserve the right at their absolute discretion to ask me to leave the tour group and ride separately from the main tour group.

RELEASE OF LIABILITY AND ASSUMPTION OF ALL RISKS.

I acknowledge that participation is entirely at my own risk and that motorcycling and travelling entails known and unanticipated risks. I also accept that such risks simply cannot be eliminated without jeopardising the essential qualities of the activity. The risks include, but are not limited to travelling in mountainous terrain, altitude, civil unrest, acts of god, forces of nature, biological warfare, pandemics, all forms of transportation, accident or illness in remote areas without means of rapid evacuation. I hereby release Freedom Motorcycle Tours Ltd, their guides, any members of staff or contractors from any and all liability arising from physical or emotional injury, paralysis, illness, death, delays, loss or damage to property, or to third parties, recklessness of any kind, and from any and all claims, demands or expenses resulting from the tour. I expressly agree and promise to accept and assume all of the risks existing in this activity. I accept that participation in this activity is purely voluntary, and I elect to participate in spite of the risks. The above release of liability and assumption of all risks statement applies to all members of my family and are binding upon my heirs, legal representatives and assigns.
